Do I have to pay anything up front to hire an attorney on my injury case?

Most injury cases are handled on a contingency fee basis, meaning the client pays nothing for attorney fees unless there is a recovery for the client. In personal injury (non workers compensation) cases such as automobile collisions, fees are usually 33 1/3%, and in workers compensation cases, fees are 25% of the amount recovered. Both of these amounts are charged after reasonable expenses of handling your claim are deducted. Some personal injury cases which require much more extensive litigation include an attorney fee of 40%, but cases settled before a lawsuit is filed do not go above 33 1/3%.

What benefits are available in a typical workers compensation case?

Persons injured on the job can obtain medical benefits, medical mileage, prescription reimbursements, lost wages, and ultimately a payment for their permanent injuries or disabilities. Recent changes in the legislature have made it more difficult to obtain benefits in workers compensation cases and it is also more difficult to leave medical benefits open for future medical needs. Typically, fault is not a consideration in determining whether these benefits are payable, although disregarding of safety devices, drug use by the employee, etc. can affect benefits. We will fight to get you all of the benefits you are entitled to under the law.

What benefits are available in a typical auto accident, premises liability, or other non workers compensation personal injury case?

In these types of cases, compensation is considered for past and future medical, past and future pain, suffering, disfigurement, etc., past and future lost wages, and any other tangible economic loss you suffer. These cases can be very complex as fault of all of the parties involved can affect your amount of recovery, and there are limitations on the damages that can be claimed and the ability to pay of the defendant often comes into question.

Do I really need to hire a lawyer for my case?

As initial consultations are free, I strongly recommend you meet with a lawyer and discuss your rights. Insurance carriers have experienced claims adjustors and lawyers working hard to make sure you don’t get many of the benefits you deserve, and it is almost always in your best interests to contact an experienced attorney.

There are many lawyers in the phonebook and on the internet. How should I decide which lawyer to hire?

The most important aspect of hiring a lawyer in my opinion is to hire a lawyer who is experienced and who you are comfortable with. While many lawyers will accept a good case, I would recommend making sure your lawyer is very experienced in handling the type of case you have, is available to meet with you at your convenience, and promptly returns phone calls. Most of the answers to these issues will be apparent when you first contact the lawyer. Lawyers who contact you quickly after your first call to their office, make a timely appointment to meet with you, and make you feel comfortable about their knowledge and abilities to communicate with you are usually going to continue representing you in the same fashion.
